3- FORMS OF CHARGING FOR LEGAL ADVISORY SERVICES IN VIETNAM
Legal fees can vary depending on the client’s case and the lawyer you choose. Typically, you will pay a lower fee if the case is simple and the lawyer is inexperienced. If the case is complex, high-value and you choose a lawyer with a lot of experience and reputation, the consulting fee will be higher.
Depending on your specific agreement with that Attorney, the amount you will pay may be calculated in one of the following ways:
a) Hourly legal consulting service fee
With this method, you will pay a fixed price for each hour the Lawyer works. For example, you need a Lawyer to consult for 02 hours on a property dispute with a price of 500,000 VND per hour. Normally, this form is chosen if you only need to meet a Lawyer to get advice on a specific question.
b) Full legal consulting service fee
According to this calculation, you will pay the Lawyer a full legal consultancy fee when the Lawyer has finished handling your case. For example, you and the Lawyer agree on a full fee of 3,500,000 VND for the business registration procedure.
b) Legal consulting service fee is calculated as a percentage of the case value.
According to this calculation, you will pay the Lawyer a certain percentage of the value of the case, contract value or project value that you hire the Lawyer to do. For example, you and the Lawyer agree on a service fee of 2% of the value of the disputed land use rights.
c) Fixed monthly legal consulting fee
According to this method, you will pay a fixed monthly fee to the Lawyer for the Lawyer to advise and perform regular legal services for you. This form is often applied if you hire a private Lawyer for yourself, your family or your business. For example, you and the Lawyer agree on a fixed service fee of VND 5,000,000/month for the Lawyer to act as a private lawyer for 10 hours/month for your company.
d) Incurred expenses
You and the Lawyer can also agree on expenses incurred during the Lawyer's work for you. For example, the Lawyer's travel expenses if the Lawyer has to travel far, or the fees for photocopying documents, sending mail, or the fees that the Lawyer pays to state agencies on your behalf when preparing documents and papers.
